General Terms and Conditions for orders from Designeria.
1. Contracting Party and Scope
The contracting party is Designeria e.U., owner Theresa Thaler, Erdbrustgasse 7/9, 1160 Vienna, Austria, email contact@designeria.at, phone: +43 676 432 6606. These GTC apply to orders placed via the Designeria online shop by consumers and businesses. Mandatory consumer protection provisions remain unaffected.
2. Offer and Conclusion of Contract
Product displays in the shop are an invitation to place an order. Before sending a binding order, you can check and correct your entries in the shopping cart and checkout. By completing the ordering process, you submit a binding offer. The automatic confirmation of receipt documents that the order has been received. The contract is concluded upon express order confirmation, acceptance of payment, or shipment of the goods – whichever occurs first.
For individual inquiries, the contract is concluded by the acceptance of a specific offer. The contract language is German. You can read, save, and print these GTC before placing your order. The contract confirmation will be sent to you by email. Individually agreed conditions take precedence over these GTC; mandatory consumer rights always remain unaffected.
3. Products and Handcrafted Items
Many Designeria products are handcrafted, one-of-a-kind pieces or small series. Minor differences in color, texture, glass, wood, concrete, fabric, or surface finishes may be due to the materials used and the nature of the craftsmanship. The agreed-upon quality, product description, illustrated design, and legally owed characteristics are authoritative. This notice does not limit warranty claims. Decoration and light bulbs are only included in the delivery if explicitly stated for the product.
Intended Use and Safety
Please observe the product description, labeling, and product-specific instructions for use. General information can be found under Safety and Care Instructions. Lighting must be operated exclusively with suitable LED bulbs. The LED wattages mentioned online are recommendations and do not replace product-specific performance limits. Safety instructions do not constitute a blanket exclusion of liability or warranty.
4. Prices and Small Business Regulation
All prices are stated in Euros as final prices. Due to the small business regulation applied to Designeria, no sales tax is shown separately. Shipping costs displayed before the completion of the order may also apply.
5. Payment Methods
The payment methods available for your order are displayed in the checkout before the binding completion of the order. Where offered, card and EPS payments, Klarna, as well as Apple Pay, Google Pay, and Shop Pay are processed via Shopify Payments or its payment partners; PayPal payments are made via PayPal. Electronic payments are authorized or charged during the ordering process. For advance payment, we will provide bank details and payment reference exclusively in the order confirmation; processing begins after receipt of payment.
6. Delivery and Shipping Costs
We deliver to addresses in Austria and Germany. Standard shipping within Austria costs €6.50 and is free for order values of €155 or more. Shipping to Germany costs €12.00 and is free for order values of €180 or more. The shipping costs displayed in the checkout are binding.
In-stock items are usually shipped within one to two business days. For personalized and custom-made products, the deadline agreed upon for the product or in the offer applies. Without a different agreement, delivery will take place within 30 days at the latest. For consumers, the risk of accidental loss or damage generally transfers only upon delivery to the consumer or a third party designated by them.
If an agreed delivery is not possible or is delayed, we will inform you immediately. We will only deliver replacement goods or implement significant changes with your consent. Your statutory rights in the event of a delay in delivery remain in effect; payments already made for services not ultimately rendered will be refunded.
7. Retention of Title
The goods remain the property of Designeria until full payment has been received.
8. Changes and Custom Orders
We will evaluate requests for changes or mutually agreed cancellations based on the respective processing status. A statutory right of withdrawal as well as other statutory rights of rescission, warranty, and performance failure remain unaffected. For custom orders, the design, material, price, and schedule are defined in the offer or product configuration. Exclusion of the statutory right of withdrawal is only possible if the legal requirements are actually met, in particular for goods made to customer specifications or clearly tailored to personal needs. Handcrafting, production only after ordering, or the mere selection of a standard variant do not in themselves constitute grounds for exclusion. We will inform you of any applicable exclusion before the conclusion of the contract.
9. Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal for distance contracts. Details, deadlines, return shipping costs, and exceptions can be found under Withdrawal and Returns. The model withdrawal form may, but does not have to, be used.
There is no statutory right of withdrawal for businesses. Deviating voluntary return options require an express agreement.
10. Warranty
The statutory warranty provisions apply, in particular the Consumer Warranty Act for contracts with consumers. For movable goods, the statutory warranty period is generally two years from delivery. Initially, improvement or replacement may be considered based on legal requirements, followed by potential price reduction or contract termination. A voluntary guarantee exists only to the extent that it has been expressly promised; it does not replace or limit the statutory warranty. In the event of a defect, please contact us with your order number and a description. Failure to immediately report transport damage does not limit statutory consumer rights.
Damages caused solely by improper use after delivery do not constitute a defect existing at the time of delivery. For claims for damages, culpable disregard for safety instructions that contributes to the damage may be taken into account in accordance with statutory provisions. Statutory warranty rights, statutory rules on the burden of proof, and mandatory liability provisions remain unaffected. Failure to follow an instruction does not automatically lead to the loss of all claims.
11. Liability
The statutory liability provisions apply. Mandatory claims, in particular for personal injury, product liability, intent, or gross negligence, are not limited.
For bottles, templates, or other materials provided by you, we will coordinate processing risks, scope, and costs before commissioning. Statutory liability claims remain unaffected. You must possess the necessary usage rights for any designs you submit. We may refuse execution if there are concrete doubts regarding these rights or technical safety.

13. Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with their habitual residence in another country, this choice of law does not affect the protection of mandatory provisions of that country. Legal regulations apply to jurisdictions.
14. Dispute Resolution and Contact
For complaints, please contact contact@designeria.at. We strive for a direct, amicable solution. Information on any potentially competent body for alternative dispute resolution will be provided in the specific case of a dispute in accordance with statutory provisions.
